1. Provider, scope and language

“Bexongo” is provided by Bexongo Technologies, a sole proprietorship owned by Sadi Mammadli, Teutonenstraße 19, 51149 Cologne, Germany. These terms apply in addition to the Driver Terms where a driver account records a transport business, creates dispatcher seats or links drivers. The account holder accepts them with authority for the business. The German version prevails.

2. Business status and authority

The owner confirms commercial activity, authority and accurate register, tax and contact details. False or stale information permits refusal, restriction, suspension or termination and makes the business liable for culpably caused loss, without limiting mandatory rights.

3. Business and document review

For a German business, required evidence may include a trade registration or current register extract where applicable, identity and authority evidence, VAT ID, Community licence or national road-haulage permit where required, carrier-liability insurance, vehicle papers, driving licences and professional qualifications. The account shows requirements applicable to the business, vehicle and drive. Bexongo records whether submitted information is legible and plausible; this is not an official check or assurance that a particular carriage is lawful. The business remains responsible for permits, insurance, qualifications, registration, load security, driving and rest times, cabotage, posting, tax and transport law.

4. Drivers and subcontractors

The business may invite and unlink drivers and remains responsible for their selection, fitness, instruction and supervision. It alone handles employment, minimum wage, social security, tax, residence and work-authorisation obligations. Subcontractors may be used only where agreed with the customer and lawful, and the business answers for them as for itself. Unlinking ends live sessions, but a claimed drive remains assigned until completed, properly released before start or administratively resolved after a report to Bexongo.

5. Dispatcher seats

The owner may invite dispatchers and grant only necessary rights. Dispatchers act for the business and a drive they claim for a driver binds the business. Rights must be removed promptly when no longer needed; a seat cannot manage other seats or permissions without express authority.

6. Vehicles

A vehicle must be recorded and approved with required details and documents. The business confirms ownership or a valid right of use and ensures insurance and roadworthiness. Transfer between businesses occurs only through Bexongo's disposal and review process and is blocked during an assigned open drive. The old business remains responsible until transfer is confirmed; afterwards only the new authorised business may use it.

7. Drives and contract model

The Driver Terms govern claims, performance, location, proof, ratings and complaints. The transport contract is solely between the customer and the business represented by the claiming account. The business invoices the customer and receives direct off-platform payment. Bexongo is neither a party nor payment service provider for the drive price.

8. Subscription

Each driver account able to claim requires its own active subscription. The owner's subscription does not automatically cover other driver accounts. The Driver Terms and Billing and Cancellation terms apply.

9. Privacy and driver data

Bexongo and the transport business are independent controllers for their own purposes. Bexongo processes data to provide, secure and govern the marketplace; the business processes employee, dispatcher and driver data for employment, deployment and transport. The business gives Article 13/14 GDPR information, establishes a legal basis and limits access. Platform use alone creates neither joint control nor processing on behalf; an additional activity performed solely on the business's instructions would require a separate agreement first.

10. Suspension, closure and open drives

Closure requires no open drive and ends dispatcher access. Open drives remain assigned and must be completed or properly released before start; otherwise Bexongo determines the technical treatment after a problem report. Bexongo may restrict, suspend or terminate for missing or expired documents, illegality, breach, false details, security risk or concrete suspected misuse. Unless immediate protection is required, Bexongo provides reasons and a reasonable chance to respond and remedy. Necessary access for safe completion or resolution remains or Bexongo handles it administratively. Retention and export follow the Privacy Notice.

11. Liability, indemnity and insurance

Bexongo has unlimited liability for intent, gross negligence, death, personal injury, mandatory product liability and express guarantees. For slight negligence affecting an essential duty, liability is limited to foreseeable, typical loss; other slight-negligence liability is excluded. The business is responsible to customers and third parties for carriage, drivers, subcontractors, vehicles, cargo, permits and transport-law compliance and indemnifies Bexongo against justified third-party claims caused by its culpable breach, except to the extent Bexongo contributed. Legally required and risk-appropriate carrier-liability and other mandatory insurance must exist before a claim. Evidence must be supplied on request and renewal, and reduced or lost cover reported immediately.

12. Changes and final provisions

Material changes are announced by email or in-account at least 30 days in advance. The owner may object and terminate before they apply; mandatory-law or urgent-security changes may apply sooner. German law applies, excluding the UN Sales Convention. Cologne is the exclusive venue for merchants and public-law entities. Legal notices go to info@bexongo.com or https://bexongo.com/contact.
