1. Provider, scope and language

“Bexongo” is provided by Bexongo Technologies, a sole proprietorship owned by Sadi Mammadli, Teutonenstraße 19, 51149 Cologne, Germany. These terms apply to driver accounts in the portal and app. A driver performs drives as a sole trader or for the named transport business. A business with several drivers or dispatchers is also bound by the Transport Business Terms. The German version prevails.

2. Business users only

The service is exclusively for businesses within section 14 BGB. An independent driver must also act commercially or professionally. Consumers may not register. A false declaration permits immediate suspension or termination and makes the user liable for culpably caused loss, without limiting mandatory rights.

3. Account and security

The account is personal. Details must be accurate and current; credentials may not be shared. Suspected misuse must be reported immediately.

4. Bexongo's role and transport contract

Bexongo shows suitable nearby drives at the customer-set price. There is no bidding and Bexongo keeps no part of the drive price. The transport contract is solely between the customer and the business represented by the driver account. That business invoices the customer and payment is settled directly outside Bexongo. Bexongo is not a party, carrier, freight forwarder, representative or payment service provider and gives no performance guarantee.

5. Claim requirements

A drive may be claimed only when the represented business is recorded, required driver, business and vehicle documents have the necessary review status, a suitable approved vehicle exists and the driver account has an active subscription. Bexongo checks submitted information for plausibility and completeness, not as an authority. Driver and business remain responsible for licensing, qualification, registration, carrier liability insurance, load security, driving and rest times, cabotage, posting, tax and permit rules. Platform notes are not legal advice.

6. Claiming and performance

Claiming commits the represented business to the customer. The driver must report statuses truthfully and provide requested proof of delivery. Before start, a drive may be released only with a true reason and is then reposted. After start it cannot be released unilaterally; problems must be reported and handled safely pending agreement or Bexongo's technical resolution. Repeated or abusive releases may restrict the account. Location sharing is optional and can be stopped at any time. While enabled during a drive, coordinates, accuracy, speed and heading may be sent in the background with device permission; customer and authorised dispatchers see the latest position, its age and route trail. No location is sent outside a running drive. Prohibited, dangerous or regulated cargo may be carried only where lawful, supported and fully permitted.

7. Ratings, communications and complaints

Ratings must be factual and drive-specific. Unlawful, abusive or threatening messages may be reported and restricted. Bexongo records complaints, preserves platform evidence and may mediate or determine a drive's technical status, but does not finally determine civil claims. The performing business remains responsible for carriage and insurance.

8. Business seats

A transport-business owner may invite authorised dispatchers and link drivers. The Transport Business Terms also apply, and permissions must be limited and current.

9. Subscription, price, term and cancellation

An active subscription is required per driver account to claim drives. At launch, Bexongo Team costs EUR 99 per month; legally applicable VAT is calculated and displayed before purchase. Bexongo Plus is not offered at launch. Website subscriptions use Stripe and renew monthly until cancelled for the end of the current period. Payment method, invoices and cancellation are managed in the portal. Where app-store purchasing is offered, Apple App Store or Google Play rules and procedures also govern purchase, renewal, cancellation and refund, and the subscription must be managed in that store. For website subscriptions, confirmed duplicate charges and billing errors are refunded; a material Bexongo-caused outage may receive a proportional refund, while other goodwill is case-specific. Cancellation alone does not refund a started period and no consumer withdrawal right applies to this B2B service. On failed payment, Stripe may retry under the schedule shown in checkout or the portal. Claiming is suspended while the subscription is past due, unpaid, cancelled or expired and restored after confirmed payment. The separate Billing and Cancellation terms also apply.

10. Suspension and termination

Deletion requires no open drive. Bexongo may restrict, suspend or terminate for expired or missing documents, illegality, breach, false details, security risk or concrete suspected misuse. Unless immediate protection is required, Bexongo provides reasons and a reasonable chance to respond and remedy. A running drive is not ended solely by suspension; access needed for safe completion or resolution remains or Bexongo handles it administratively.

11. Privacy

The Privacy Notice explains document review, location data, recipients and retention and is not a contractual term.

12. Availability and rights

No specific service level is promised. Maintenance is announced where practicable; urgent security work may be immediate. The service may evolve while its core remains. Software, marks and content remain protected; the user receives a simple, non-transferable right for the contract term.

13. Liability and indemnity

Bexongo has unlimited liability for intent, gross negligence, death, personal injury, mandatory product liability and express guarantees. For slight negligence affecting an essential contractual duty, liability is limited to foreseeable, typical loss; other slight-negligence liability is excluded. Bexongo is not liable for carriage or obligations between customer and performing business unless it caused the loss under these rules. Driver and business indemnify Bexongo against justified third-party claims caused by their culpable breach, unlawful carriage or false information, except to the extent Bexongo contributed.

14. Changes

Material changes are announced by email or in-account at least 30 days in advance. The user may object and terminate before they take effect. Mandatory-law or urgent-security changes may apply sooner with reasons. A version requiring consent must be accepted before continued use.

15. Final provisions

German law applies, excluding the UN Sales Convention. Cologne is the exclusive venue for merchants and public-law entities. Legal notices go to info@bexongo.com or https://bexongo.com/contact. Invalidity of one provision does not affect the rest.
